TikTok Vouchers’ contest

REGULATION

1. DESCRIPTION
   1. The following terms and conditions are intended to regulate the online contest ‘TikTok Vouchers’, hereinafter referred to as the ‘Contest’, promoted by BENNIE, LDA, (hereinafter referred to as ‘BENNIE’) legal person no. 505490889, with registered office at Rua Industrial no. 1770, 4750-841, Barcelos, share capital €100,000.00, and subject to the following terms and conditions. Participation in this contest implies acceptance of and subjection by the participants to the terms set out in these Regulations.
   2. The ‘TikTok Vouchers’ contest will be valid from 07/05/2025 to 31/08/2025.
   3. This contest is being promoted via the ‘BENNIE KIDS’ TikTok page. (https://www.tiktok.com/@benniekids1998).
2. PARTICIPATION CONDITIONS
   1. The contest is for all individuals resident in Portugal, who recognise and accept all the points of these regulations. Participation by children under the age of 18 is permitted provided their parents or guardians authorise it.
   2. BENNIE reserves the right to eliminate any entry that does not comply with these Regulations.
   3. Participation in this contest implies express authorisation by the participants and the people they identify to transfer the rights to reproduce, communicate, disseminate or in any way publicise the entries submitted on BENNIE KIDS TikTok. Authorisation to publicise the entries submitted under this contest is granted by each participant, of their own free will, at the time of their application, and BENNIE is not required to pay any compensation and/or remuneration for this.
3. CONTEST MECHANICS
   1. The contest is intended exclusively for users of the TikTok social network. For participation to be considered valid, each participant must fulfil the following conditions:
      1. Hold a profile on TikTok;
      2. Have a profile on TikTok and Follow the BENNIE KIDS TikTok page (@benniekids) by ‘liking/following’ it;
      3. Share a creative video in which the participants are wearing an outfit from our brand, BENNIE. The description of the video must mention the page @benniekids1998 and use the hastag #benniekids;
   2. Any type of inappropriate content, including images, phrases or messages which, due to their presentation, language used or other aspects, could be considered offensive to good customs, rules of good manners and/or which constitute a violation of third party rights, will not be considered for participation in this contest.
   3. BENNIE reserves the right to exclude any entries that in any way contravene the law, are inappropriate and/or offensive to good behaviour, may infringe the rights of third parties, are considered fraudulent and/or in any way abusive.
   4. Participation in the contest implies compliance with the rules set out in these Regulations by all participants, who will be responsible for the content they submit within the scope of the contest.
   5. Entries submitted as part of this contest will only be considered valid and accepted if they fully comply with all the rules set out in these regulations.
4. WINNER SELECTION AND ANNOUNCEMENT
   1. The winner will be chosen by the BENNIE team based on the creativity, style and originality of the video. Each week’s winner will be announced on Mondays on the official TikTok account.
5. PRIZE
   1. Within the scope of this Contest, one winner will be chosen, according to the criteria defined in point 4. of these regulations. The following prize will be awarded: €60 voucher to be redeemed in the BENNIE Online Store (www.bennie.pt).
      1. The voucher is valid for 6 (six) months from the moment it is delivered to the winner.
      2. The voucher can only be used once and redeemed for a single purchase, and does not necessarily have to be discounted in its entirety.
   2. The prize in this contest is personal and non-transferable and cannot be redeemed for cash.
   3. Once the winner of this Contest has been notified, they are obliged to confirm and accept their prize, which must be processed by private message, sent via BENNIE KIDS TikTok, within a maximum of 7 (seven) days from the date of notification of the winners.
   4. After confirming and accepting the prize, as mentioned in the previous point, the winner must send a private message with the following information: Name, Telephone/Mobile number and email address where you want the prize sent.
6. PROCESSING OF PERSONAL DATA
   1. BENNIE, LDA is the entity responsible for processing the personal data collected as part of the management of the Contest, specifically for selecting and announcing the winner and delivering the prize.
   2. For the purposes of selecting and announcing the winner, the username of TikTok will be processed, and for the delivery of the prize, the above personal data of the participant who wins the prize will be processed, based on the execution of the contest within the framework of the contractual relationship established with the participants.
   3. The data collected for the delivery of the prize to the winner will be kept for 30 days after the delivery of the prize and will be deleted at the end of that period.
   4. Under the terms of the legislation in vigour, the right of access, rectification, limitation, portability and deletion of your personal data is guaranteed, and you may exercise any of the aforementioned rights via the email address comercial@bennie.pt. The data subject also has the right to lodge a complaint with the CNPD if they believe that the processing of their data by BENNIE violates the legal regime in force.
7. VARIOUS PROVISIONS
   1. BENNIE reserves the right to terminate, alter, shorten, delay or extend this Contest in the event of any illegal or fraudulent activity, or any external factor beyond its control that affects the smooth running of the contest, and participants are not entitled to compensation of any kind.
   2. Participation in the contest implies acceptance by the participants of the terms and conditions set out in these regulations.
   3. Failure to comply with any of the conditions set out in these Regulations may result in the exclusion of an entry.
   4. BENNIE reserves the right to amend these regulations at any time, whenever it deems it necessary, with the amendments becoming effective upon publication.
8. ADVERTISING
   1. Publicity relating to this contest will be carried out via the internet and other means that BENNIE deems appropriate, and BENNIE undertakes to clearly set out all the conditions relating to it, although this does not exempt all participants or potential participants from consulting and reading these regulations beforehand.
9. QUESTIONS ABOUT THE CONTEST
   Any questions regarding the contest should be sent by private message via TikTok to the BENNIE KIDS page accessible at https://www.tiktok.com/@benniekids1998.
10. LAW AND FORUM
    1. This Regulation shall be applied under Portuguese law.
    2. These rules are applied in accordance with Portuguese law. Any disputes arising from participation in the Competition, including those relating to the interpretation, incorporation or application of these Rules, shall be submitted to the Braga District Court, to the exclusion of any other court.
